The Husband's Intention is Considered in Matters of Divorce

Question

As-salamu-alaykum,
My husband and I had a fight after I found out he was watching inappropriate content. I told him that if he continued doing it, refused to change, and it kept happening, then our marriage would be over because I couldn’t live with it. He replied, “Okay.” Later, he told me that he did not mean to accept this condition; he only wanted to acknowledge my feelings. He never gave me the right to divorce myself.
Would his response make my statement legally binding if he does it again?

Answer

All perfect praise be to Allah, The Lord of the Worlds. I testify that there is none worthy of worship except Allah, and that Muhammad  sallallaahu  `alayhi  wa  sallam ( may  Allaah exalt his mention ) is His slave and Messenger.

The husband's saying "OK" in response to your words is not explicit in signifying a conditional divorce, nor in delegating to you the authority to pronounce divorce. What the husband intended by what he said is what is taken into consideration, since he knows his own intention best.

As long as he has said that he did not intend any of that by it, then no divorce and no delegation results from it.
